2010 ADA Standards For Accessible Design

Below is a copy of the 2010 ADA Standards for Accessible Design or (“2010 Standards”). These regulations are the current accessibility standards for post March 15, 2012, construction throughout the United States. This 279 page document promulgated by the Department of Justice contains architectural standards and other regulations that must be strictly followed for a facility to be considered accessible for disabled persons. If these standards are ignored, then a property owner, tenant or operator may be subject to a lawsuit under the Americans with Disabilities Act (“ADA”) or other companion state statutes. 1991 ADA Standards For Accessible Design

Below is a copy of the 1991 ADA Standards for Accessible Design or (“2010 Standards”). These regulations are the current accessibility standards for construction post January 26, 1992 and pre-March 15, 2012 throughout the United States. For construction during this period, the regulations must be strictly adhered. For construction existing prior to 1992, modifications must be made to meet these standards to the extent readily achievable without causing an undue burden. Consequently, even when the property in question was existing prior to 1992, modifications must still be made to bring the property as close to code as possible or it may be subject to an ADA claim. The Primer for Small Business, also put out by the Department of Justice, provides an excellent summary of the ADA Standards and is more readable and digestible to the general public. Review of this document may be beneficial to understanding the ADA and its regulations without spending weeks in the 1991 and 2010 ADA Standards.
